Rental Contract

On the one hand,

 

Olidesi® by CMLA Gestion, acting as representative of the owner lessor,

 

And on the other hand,

 

The tenant, having booked a stay, hereinafter referred to as the “Tenant”.

 

Olidesi® and the Tenant, hereinafter referred to as the “Parties”.

 

1. ARRIVAL AND DEPARTURE IN THE APARTMENTS

Arrival is from 3 p.m. until 8 p.m. unless a different time has been agreed at least 72 hours before arrival. The departure must be made before 11:00 am, unless a different time has been agreed at least 24 hours before the scheduled departure. Additional costs may be due in this case, depending on the availability of the apartment.

 

2. RESERVATION AND PAYMENT OF THE RENTAL

  • A deposit of 25% of the amount of the reservation must be paid at the time of booking. The full balance is due no later than thirty (30) days before the scheduled arrival date. The total amount of the reservation is due upon reservation if it takes place less than thirty (30) days before arrival.
  • We use a secure online payment platform. We cannot accept payment for rental or services in cash or checks, only by bank wire transfer or by credit or debit card.

 

3. INTERVENTION/REPAIR

If during the stay Olidesi® must call on, at the Tenant's request, companies to repair damaged equipment (blocked pipes, damaged household appliances, broken glass for example) and if Olidesi®'s responsibility is not in question, these interventions will be invoiced. In case of loss of keys, replacement of keys and lock will be charged to the customer.

 

4. SECURITY OR DEPOSIT

A deposit or security deposit of {deposit} is required to cover any damage caused by the Tenant or additional services not paid when paying the balance of the reservation. In the event of proven damage or unpaid costs at the time of departure, this sum may be fully cashed. This security deposit will be collected 7 days prior to arrival by credit card only and reimbursed within 7 days after departure, if no damage is incurred.
Access to the apartment will not be possible if the deposit is not paid before the day of arrival.

 

5. INVENTORY (OF FIXTURES)

The apartment will have been checked before your arrival by a member of the Olidesi® team. If you notice a malfunction or deterioration of the apartment, please report it to us immediately by email at booking@olidesi.com. Otherwise, your responsibility could be engaged for the problems discovered at the end of your stay.

 

6. RESPONSIBILITY

All the accommodation has been checked and examined by a member of the Olidesi® team. The descriptions given on the site www.olidesi.com or that of the partner used to book are in accordance with reality and have been written in good faith. In the event of a complaint, the Tenant undertakes to notify Olidesi® within 48 hours by e-mail. The Tenant agrees to collaborate with Olidesi® in an attempt to resolve the problem. In the absence of written communication and explicit authorization from Olidesi®, the Tenant who leaves his accommodation before the agreed date will lose the right to a possible refund of the rental amount. Any complaints notified after the end of the stay will not give rise to any refund. Olidesi® reserves the right to terminate the contract before or during its execution if unforeseeable circumstances or a case of force majeure would make the enjoyment of the apartment impossible. Olidesi® reserves the right to allocate to the client another accommodation with similar or superior characteristics. If the Tenant refuses to transfer the reservation, Olidesi® reimburses him the full amount paid for the reservation, in this case no compensation will be granted.

 

7. INTERNET/WI-FI NETWORKS

Access to the internet/Wi-Fi network is included in the rental, unless otherwise specified in the description of the apartment on the website www.olidesi.com or that of the partner used for the reservation.

 

8. HOUSEHOLD LINEN

Linen for the number of people specified by Tenant when booking is provided: sheets, towels, bathmat, kitchen towel. A change of household linen during the stay can be offered at an additional cost.

 

9. SMOKING

Smoking is strictly prohibited in the common areas and inside the apartments. In case of non-compliance with this obligation, additional costs will be charged to the Tenant.

 

10. DEFAULT OF PAYMENT

In the absence of payment by the due dates or in the event of non-execution of one of the clauses of this commitment and five working days after a simple summons by registered letter remained unsuccessful, this contract will be immediately terminated, and the lessor may avail himself of the article 1590 of the civil code to keep the deposit paid as first damages.

 

11. RESOLUTORY CLAUSE

The furnished apartment is exclusively subject to seasonal rental. As such, this rental is excluded from the scope of Law No. 89-462 of July 6, 1989.

 

12. HOUSE RULES

The rental is strictly reserved for the Tenant and for the number of people specified when booking. We ask you to respect the accommodation as if it were yours and ask you to return the accommodation to us in the condition in which you found it. When you leave, make sure the accommodation is not dirty beyond normal use. The cleaning is included but we ask you to tidy up, empty the trash cans and do the dishes and put them away.

 

13. CANCELLATION/MODIFICATION OF RESERVATIONS

  • Deposit made at time of reservation or balance paid thirty (30) days prior to arrival are non-refundable in case of cancellation, unless different Terms & Conditions are agreed at time of booking.
  • Any modification to existing reservations shall be approved in writing by Olidesi® and will be subject to Administration fees and the then applicable Rental Contract and any additional fees or charges based on the new booking dates requested.

 

14. LANGUAGE OF THE CONTRACT AND ATTRIBUTION OF JURISDICTION

The Rental Contract is written in French. A translation into a foreign language is provided for information. In case of contradiction, only the French version (Here) will prevail between the Parties.


In the event of a dispute, prior mediation must be initiated between the Parties. In the absence of agreement within thirty (30) days, the most diligent Party may seize the competent jurisdiction of the place of accommodation which is the subject of this Contract.
